Disputes happen.
When they do, Brian believes that negotiation and mediation are the first choice in resolving them. Results in negotiation and mediation are achieved by persuasive arguments solidly grounded in fact and law. However, in resolving disputes, Brian also believes in the maxim “to make peace, prepare for war”. Putting your case in the hands of an experienced trial lawyer, allows you to negotiate from a position of strength.
When negotiations fail and trial is necessary, results are obtained with thorough preparation, attention to detail and a sound mastery of proven trial techniques. Brian has successfully assisted clients facing a diverse range of legal challenges including contract and commercial disputes, leasing disputes, insurance disputes, partnership and minority shareholder disputes, breach of fiduciary duty claims, construction liens, woodsmen’s liens, wrongful dismissal claims, labour arbitration, personal injury and wrongful death claims, First Nations land claims, fisheries disputes, trade mark disputes, environmental contamination, products liability, expropriation, quieting titles, bankruptcy, debt recovery, probate disputes, division of family property, child custody and criminal and regulatory prosecutions.
Brian appears regularly in the Nova Scotia Supreme Court and the Nova Scotia Court of Appeal and has represented clients before a number of administrative boards and tribunals in Nova Scotia, including the Utility and Review Board, the Labour Standards Tribunal and the Workers’ Compensation Board. He has also represented victims’ families at judicial inquiries under the Public Inquiries Act and the Fatal Investigations Act, including the Westray Families Group at the Westray Mine Public Inquiry.
Brian has also appeared outside of Nova Scotia in the Supreme Court of Canada, the Federal Court of Appeal, the Federal Court of Canada, the Ontario Court of Appeal, the Ontario Superior Court, the Ontario Court of Justice, the Manitoba Court of Queen’s Bench, the New Brunswick Court of Queen’s Bench and the United States Bankruptcy Court (Southern District of Florida).
Brian has a particular interest in civil jury trials.
